Terms & Conditions
Effective September 27, 2026
These Terms & Conditions govern all bookings, purchases, photography services, videography services, drone services, media delivery, and related services provided by A1Media. By booking a service, submitting payment, creating a client account, or otherwise engaging A1Media, the client (“Client,” “you,” or “your”) agrees to these Terms & Conditions.
1. Services
A1Media provides real estate photography, videography, drone media, property marketing content, and other media services described within the selected package, proposal, invoice, or booking confirmation.
The exact deliverables included in your project are determined by the package or service selected at the time of booking.
Services not specifically included in the selected package may require an additional fee.
2. Booking & confirmation
A booking is not considered confirmed until all required booking information has been submitted and any required deposit or payment has been received.
Clients are responsible for providing accurate:
- Property address
- Contact information
- Property details
- Requested services
- Appointment information
- Access instructions
- Special requests
A1Media is not responsible for delays caused by incorrect, incomplete, or outdated information provided by the Client.
3. Payment
Pricing is based on the services, property information, and package selected at the time of booking.
Payment requirements will be displayed during booking or communicated before service.
Depending on the project, A1Media may require:
- Full payment before the appointment;
- A 25% deposit before the appointment, with the remaining balance due later; or
- Payment according to another written arrangement approved by A1Media.
Any additional work requested outside the original booking may result in additional charges. Final media may be withheld until all required payments are completed.
4. Property readiness
The Client is responsible for ensuring the property is ready for photography or filming before the scheduled appointment. This may include:
- Cleaning and organizing the property;
- Removing unnecessary personal items;
- Preparing rooms and exterior areas;
- Ensuring requested spaces are accessible;
- Securing pets;
- Providing access to the property.
A1Media may make reasonable visual adjustments during the shoot but is not responsible for cleaning, staging, moving substantial furniture, repairing the property, landscaping, or preparing the property unless separately agreed upon. The photographer may photograph the property in its condition at the time of arrival.
5. Property access
The Client is responsible for ensuring A1Media has legal and authorized access to the property.
By providing access instructions, lockbox information, entry codes, keys, or other access methods, the Client represents that they have authorization to allow A1Media to enter the property for the scheduled service.
A1Media is not responsible for appointments that cannot be completed because access was unavailable or improperly provided.
6. Appointments, rescheduling & cancellations
Clients should notify A1Media as soon as possible if an appointment must be changed or canceled.
A1Media reserves the right to establish cancellation or rescheduling fees for appointments canceled with insufficient notice. Additional charges may apply when:
- The photographer has already traveled to the property;
- Access to the property is unavailable;
- The property is not reasonably prepared;
- The appointment must be repeated because of circumstances outside A1Media's control.
Weather-dependent services, including certain exterior and drone services, may be rescheduled when conditions do not allow the service to be completed safely or professionally.
7. Weather
Weather conditions can affect exterior photography, drone operations, lighting, and other services. A1Media will determine whether conditions are appropriate and safe for the requested service.
Cloudy skies, seasonal conditions, property surroundings, construction, traffic, neighboring properties, landscaping, and other environmental factors are generally considered part of the property's existing condition.
Requests for major environmental changes or advanced image alterations may require additional editing fees.
8. Drone services
Drone services are subject to:
- Weather;
- Airspace restrictions;
- Federal, state, and local regulations;
- Property restrictions;
- Safety conditions;
- Temporary flight restrictions;
- Pilot judgment.
A drone service may be modified, delayed, or canceled when safe or legal operation is not possible. A1Media does not guarantee that drone footage can be captured at every property.
9. Delivery times
A1Media aims to deliver media according to the turnaround time associated with the selected service. When a package states that HDR photography is delivered within approximately 24 hours, the delivery timeframe begins after the photography session has been completed. Delivery times may be affected by:
- Large projects;
- Additional editing requests;
- Technical interruptions;
- Holidays;
- Severe weather;
- Client-requested revisions;
- Circumstances outside A1Media's reasonable control.
Unless specifically guaranteed in writing, stated delivery times should be considered expected turnaround times rather than absolute deadlines.
10. Media delivery
Completed media may be delivered through the A1Media Client Portal, downloadable gallery, email, file-sharing service, or another approved delivery method.
Clients are responsible for downloading and safely storing delivered files.
A1Media does not guarantee permanent storage of completed files unless a specific storage service is included in the Client's package.
11. Editing
Standard editing may include reasonable professional adjustments such as exposure correction, color correction, HDR processing, cropping, image alignment, basic visual cleanup, and standard video editing.
Standard editing does not automatically include extensive manipulation such as removing large objects, replacing major property features, altering permanent structural conditions, significant virtual remodeling, extensive item removal, advanced compositing, or specialized virtual staging. These services may be available for an additional fee.
12. Revisions
Clients should review delivered media promptly.
If a reasonable correction is required because the delivered media does not reflect the agreed service, the Client should notify A1Media within 7 calendar days of delivery. Requests submitted after this period may be treated as a new editing request.
Changes based primarily on preference rather than an error in the original service may require an additional fee.
13. Reshoots
A complimentary reshoot is not automatically provided when the property changes after the original appointment. Additional charges may apply when a reshoot is requested because of:
- Furniture changes;
- New staging;
- Property repairs;
- Landscaping changes;
- Personal items present during the original session;
- Incorrect instructions;
- Property conditions;
- Client scheduling changes;
- Weather conditions that were accepted for the original appointment.
If A1Media determines that a reshoot is reasonably necessary because of a material service error caused by A1Media, an appropriate correction may be provided.
14. Copyright & ownership
Unless otherwise agreed in writing, A1Media retains the copyright and ownership rights to photographs, videos, drone footage, edited media, and other creative work produced by A1Media.
Payment provides the Client with a license to use the delivered media for the intended marketing purpose associated with the property or project.
Copyright ownership is not transferred unless specifically agreed in writing.
15. Client usage license
After required payment has been completed, the Client may use delivered media for purposes reasonably associated with marketing the photographed property, including:
- MLS listings;
- Real estate websites;
- Social media;
- Advertising;
- Printed marketing materials;
- Property presentations.
The license applies to the Client and the specific property or project for which the media was purchased unless otherwise agreed. Media may not be resold, transferred, sublicensed, or commercially distributed to unrelated third parties without permission from A1Media. Builders, designers, architects, contractors, property managers, publications, and other third parties wishing to use the media may be required to obtain separate permission or licensing.
16. Portfolio & marketing use
Unless the Client communicates a confidentiality restriction to A1Media in writing before the service, A1Media may use completed media for reasonable portfolio and business-promotion purposes, including:
- A1Media's website;
- Social media;
- Digital advertisements;
- Demonstration galleries;
- Printed portfolio materials;
- Promotional materials.
A1Media will make reasonable efforts not to publicly display confidential information intentionally provided by the Client.
17. MLS & third-party platforms
A1Media provides media that may be used on MLS platforms, Zillow, social networks, brokerage websites, and other third-party services.
A1Media is not affiliated with or responsible for the rules, approval processes, technical requirements, availability, changes, outages, placement, performance, or decisions of third-party platforms unless expressly stated otherwise in writing.
Purchasing a service that prepares media for a particular platform does not guarantee placement, partnership status, special treatment, or acceptance by that platform.
18. Client portal
A1Media may provide Clients with access to an online Client Portal containing bookings, delivered media, receipts, account information, or other project information.
Clients are responsible for maintaining the confidentiality of their login credentials. Clients should immediately notify A1Media if they believe their account has been accessed without authorization.
A1Media may modify, upgrade, replace, or temporarily disable portions of the portal when reasonably necessary for maintenance, security, or system improvements.
19. Communication
Clients may communicate with A1Media using the communication methods available through the website, booking confirmation, email, telephone, or Client Portal. The Client agrees that A1Media may send communications related to:
- Appointments;
- Booking confirmations;
- Project status;
- Media delivery;
- Payments;
- Account security;
- Service updates;
- Customer support.
Marketing communications may be subject to separate consent requirements where applicable.
20. Promotional codes
Discounts, promotional codes, loyalty offers, or one-time-use codes:
- Have no cash value;
- Cannot be redeemed for cash;
- May have expiration dates;
- May be limited to certain services;
- May be restricted to one use;
- May not be combined unless specifically permitted.
A1Media may modify or discontinue promotional offers at its discretion, subject to any applicable law.
21. Refunds
Because A1Media provides scheduled and customized creative services, payments for completed services are generally non-refundable.
Refund eligibility for canceled services will depend on:
- How much notice was provided;
- Whether work has already begun;
- Whether travel has occurred;
- Whether editing or preparation has begun;
- Any applicable cancellation policy communicated during booking.
Nothing in this section limits rights that cannot legally be waived.
22. Client responsibility
The Client is responsible for reviewing:
- Booking information;
- Property information;
- Service selections;
- Delivery information;
- Billing information;
- Final media.
The Client should notify A1Media promptly if any information is inaccurate.
23. Limitation of liability
To the maximum extent permitted by applicable law, A1Media will not be liable for indirect, incidental, special, consequential, or lost-profit damages resulting from use of the services or delivered media.
If A1Media is found responsible for a claim related to a particular service, A1Media's total liability for that claim will not exceed the amount the Client actually paid A1Media for the service giving rise to the claim, except where applicable law requires otherwise.
24. Events outside our control
A1Media will not be responsible for delays or inability to perform caused by circumstances reasonably outside its control, including severe weather, natural disasters, emergencies, government restrictions, equipment failure, power outages, internet outages, illness, transportation disruptions, or third-party service interruptions.
When reasonable, A1Media will attempt to reschedule or otherwise provide an appropriate solution.
25. Safety
A1Media personnel are not required to perform services under conditions reasonably believed to be dangerous, unlawful, threatening, or unsafe.
This includes unsafe structures, aggressive animals, hazardous environments, unsafe weather, restricted airspace, or other conditions presenting unreasonable risk.
26. No guarantee of property performance
A1Media provides professional media and marketing-related services. A1Media does not guarantee:
- Property sales;
- Offers;
- Showing activity;
- Listing views;
- Social media engagement;
- Buyer interest;
- Closing dates;
- Listing performance;
- Revenue or return on investment.
Results depend on numerous factors outside A1Media's control.
27. Privacy
Information submitted through A1Media's website, booking system, Client Portal, or other systems may be used to provide and administer services.
A1Media will make reasonable efforts to safeguard Client information and will handle personal information according to its applicable Privacy Policy.
28. Third-party services
A1Media may use third-party platforms to support payments, scheduling, email, file delivery, communication, hosting, analytics, or other business functions.
Use of those services may also be governed by the respective provider's terms and privacy practices.
A1Media is not responsible for third-party outages, policy changes, interruptions, or independent actions outside A1Media's reasonable control.
29. Changes to these terms
A1Media may update these Terms & Conditions as its services evolve. Updated Terms will become effective when posted or otherwise communicated.
The Terms in effect at the time a service is booked will generally govern that transaction unless otherwise required by law or mutually agreed in writing.
30. Governing law
These Terms will be governed by the laws applicable to A1Media's principal place of business, without regard to conflict-of-law principles, except where another jurisdiction's laws are required to apply.
31. Severability
If any portion of these Terms is determined to be invalid or unenforceable, the remaining portions will remain in effect to the fullest extent permitted by law.
32. Entire agreement
These Terms, together with the applicable booking confirmation, invoice, service description, proposal, and any separately signed agreement, represent the agreement between A1Media and the Client regarding the applicable services.
If a separately signed written agreement contains terms that directly conflict with these website Terms, the signed agreement will control for that specific project.
33. Acceptance
By submitting a booking, making payment, or selecting an acknowledgment stating that you agree to the A1Media Terms & Conditions, you confirm that you have reviewed and accepted these Terms.
